1. ORGANISER:
BPW-Hungária Kft. (HU-9700 Szombathely, Körmendi út 98.,( https://bpw-hungaria.hu/en) email address: info@bpwagrar.com) hereinafter referred to as Organiser, who organises and executes the prize game on the https://www.facebook.com/bpwagrar/ site, with the title “Keep Rollin’ with BPW”.
2. PLAYER:
• All natural person Internet users over the age of 18 who have European Union citizenship may participate in the Prize Game.
• If the winner is a person with limited capacity to act who is not limited in his/her participation in the Prize Game, then such person shall be entitled to take substantive actions regarding the prize and to receive the prize only together with his/her legal representative.
3. RULES OF PARTICIPATION:
• The employees and agents (hereinafter referred to as Agent) of Organiser, the employees and contributing parties of Organiser, as well as the close relatives of such persons under Section 8:1(1)(1) if the Civil Code shall not participate in the prize game.
• The organisation of and participation in the Prize Game shall be governed by these Prize Game Rules. If any matter is not regulated by the Prize Game Rules, then the relevant provisions of the applicable legislation must be applied.
• If the Player does not accept or object to these rules of participation or any provisions thereof, then such person shall not be entitled to participate in the Prize Game and will be automatically excluded from the Prize Game.
• The Player’s participation shall be invalid in case violation of the Prize Game Rules.
DESCRIPTION OF THE PRIZE GAME:
• The Player shall like the original posts announcing the prize game.
• The Player shall take a photo of his/her agricultural trailer.
• The Player shall send the photo made to BPW-Hungária Kft. in a Facebook message (https://www.facebook.com/bpwagrar/).
• The same Player may send no more than 5 photos taken BY THE PLAYER HIMSELF/HERSELF of the same trailer.
• Pictures showing the BPW cap are worth a double entry.
• The prize game is not organised by Facebook.
• Participation in the prize game is free of charge.
• The winner shall be drawn by Organiser randomly.
4. DURATION OF THE PRIZE GAME:
• The duration of the Prize Game: 28 September 2023 – 30 October 2023
• Deadline for sending phots: Midnight of 30 October 2023
• Draw of winners: 31 October 2023
• Announcement of the results within 48 hours of the draw of the winners, the organiser shall notify the winners via private Facebook message.
5. REQUIREMENTS RELATED TO THE PHOTOS:
• Organiser shall accept only those photos submitted by Player which comply with the following criteria:
o The photo must be taken by the Player himself/herself.
o The BPW branding on the BPW cap of the agricultural trailer must be unambiguously and easily recognisable in the submitted photo.
o Only images of agricultural trailers may participate in the Prize Game.
o Only images of agricultural trailers equipped with BPW undercarriage may participate in the Prize Game.
o The photo shall not include any image of any natural person in an identifiable manner.
o Organiser shall not be obliged to investigate the origin of the images, and Organiser shall not be liable for any copyright infringements committed by the Applicant.
6. PRIZE:
• The prize drawn at the end of the Prize Game is an admission ticket to the Agritechnica (Hannover) exhibition (Brief information about the exhibition is attached to the Prize Game Rules).
• The organiser will draw 25 winners
• 1 winner will receive 2 Agritechnica daily admission tickets via email.
• The Prize cannot be exchanged for cash and other products.
7. NOTIFICATION OF THE WINNER:
• Organiser shall notify the winners via private Facebook message within 48 hours of the draw.
• Organiser shall announce only the end of the game in the Facebook post, Organiser will not communicate the identity of the winners publicly.
• The purpose of making contact shall always be to arrange the details of receiving the prize.
• If the winner fails to answer and therefore cannot be contacted within the 15 working days specified, then the winner shall not be entitled to the prize.
• In order to identify and inspect the identity of the winner, Organiser may oblige the winner to verify his/her identity. If the winner fails to act in accordance with the notification message/email, or if the winner refuses to provide one or more of the requested data to Organisers in writing, then such winner may become ineligible for the prize.
• Organizers reserve the right to release the prize exclusively to the winner or his/her close relative.
• The Winner shall cooperate with Organiser in connection with the delivery of the prize.
• The winner shall not be entitled to receive the prize if:
o the winner was under the age of 18 at the time he/she applied to the prize game;
o the winner fails to respond to the Facebook message sent by the organiser (reply message to the message in which the Player who wished to apply to the prize game sent his/her photo/photos to Organiser) within 15 working days at the latest.
o for any reason the winner cannot be contacted;
o it can be proven unambiguously that the winner participated in the Prize Game with multiple and/or false registration, through which the winner gained undue advantage;
o it can be proven unambiguously that the winner is attempting to wilfully influence the process/result of the Prize Game in any way,
o the winner violates any section of these rules.
8. LIABILITY:
• The Prize Game is not related to Facebook in any way, Facebook does not support it. Participants in the Prize Game do not provide information and data to Facebook.
• The Player acknowledges that Organiser shall not be liable for technical problems occurring during the Prize Game, or for downtimes and difficulties resulting from system and server overload.
• Organiser reserves the right to change the rules (Prize Game Rules), mechanism and the prizes of the Game. Organiser shall not be liable for typographical errors that may occur in any communication material related to the Prize Game.
• Organiser reserves the right to change the conditions of the prize game subject to notifying the participants. Organiser shall publish the amendment of the Prize Game Rules and the notification about the possible termination of the Prize Game on the Facebook pages of BPW-Hungária Kft. The participants of the prize game shall be responsible for keeping themselves properly informed of these changes.
• In matters not regulated herein, the Data Protection and Data Processing Procedure, as well as the relevant provisions of the Civil Code shall be applied.
9. DATA PROTECTION AND DATA PROCESSING PROCEDURE:
By participating in the Prize Game, the Player or Winner grants his/her unconditional consent to his/her personal data specified in Section 9.3. being processed by Organiser in the framework of the prize game.

9.1 Purpose of the data processing
• Data Controller shall be entitled to process the personal data of the Player for the purpose of participation in the prize game and the organisation of the handover of the Prize.
9.2. Legal basis of the data processing
The data processing is based on the consent of the Player.
9.3 Scope of the personal data processed:
Data Controller processes exclusively those personal data of the Player for the purpose specified in the Prize Games Rules which had been provided by the Player to the Data Controller voluntarily, in course of the participation in the prize game.
Data Controller and Data Processor process the following personal data of the Players in connection with the Prize Game:
• In case of Players:
o Facebook profile name and the profile picture made public)
• In case of the Winner
o name
o e-mail address
o Facebook profile name and the profile picture made public)
• The Player may request information on the data processing at any time.
• In connection with the processing of the data, as legal remedy, the participants have the right to rectification, erasure, restriction, objection and the right to legal remedy.
9.4 Duration of the data processing
• Data Controller shall be entitled to process the personal data of the Player throughout the duration of the prize game and for an additional 3-month period.
9.5 Data security
Data Controller and Data Processor shall ensure the security of the Personal Data of the Player and shall take those technical and organisational measures which guarantee the appropriate security of the personal data of the Player.
9.6 Withdrawal of the consent
The Player may withdraw his/her consent at any time, subject to no restriction or reasoning, free of charge, via e-mail sent to the following e-mail address, in e-mail or mail consignment sent to Data Controller.
9.7. The cross-border processing of the personal data
In course of the processing of the personal data, no cross-border processing thereof takes place, considering processing of personal data takes place in the context of the activities of a single establishment of the data controller, which however does not substantially affect or is not likely to substantially affect data subjects in more than one Member State.
9.8. Legal remedy
You may contact the representative of Data Controller in connection with the processing of your personal data related to the Prize Game. All players shall be entitled to lodge complaints if the processing of their personal data is infringed, with a supervisory authority, in particular in the Member State of his or her habitual residence, place of work or place of the alleged infringement. In Hungary, the Supervisory authority is the National Authority for Data Protection and Freedom of Information (HU-1125 Budapest, Falk Miksa utca 9-11.; mailing address: HU-1374 Budapest, Pf. 603.).
In addition, the Player may seek legal remedy from the court that has competence and territorial jurisdiction for proceeding in the Member State where the Data Controller is established. The proceeding may also be initiated before the court seated at the habitual residence of the Player.
10. FINAL PROVISIONS
• In case of the invalidity of any of the provisions of these Prize Game Rules, such invalidity shall not affect the validity of other parts of the Prize Game. In this case, the invalid provision of the Prize Game Rules shall be replaced by the relevant and effective provision of the effective Hungarian laws.
